The idea sounds bulletproof. Stop drunk drivers before they even turn the key. Save lives. It was the logic behind a specific mandate in the 2021 Infrastructure Investment & Jobs Act. New cars must include technology to prevent impaired driving. The problem is that the government wants it now and the tech isn’t there yet.
We already have ignition interlock devices (IIDs). You know the ones. Courts force offenders to blow into a tube to start their car. That works. It’s active. The new rule demands something different. It demands passive alcohol detection systems that figure out if you are impaired without asking you to do anything.
Imagine sensors in the steering wheel. Or cameras watching your eyes for drowsiness. Maybe the car analyzes your breath as you exhale naturally. The goal is to detect alcohol concentration through the skin or track steering inputs that scream “distraction.” Then, the car stops you. Or limits your speed. Or shuts down.
Sounds safe, right?
Lawmakers in Washington say no. Not even close.
Why Politicians Oppose Mandatory In-Car Sobriety Sensors
There is significant pushback against the mandate for passive alcohol detection. The Alliance for Automotive Innovation, the group that represents major automakers, is worried. They fear false positives. Imagine being pulled over—or worse, stranded on the highway—because a sensor decided your morning coffee smelled like vodka. Or because you had a cold.
Rep. Thomas Massie (R-KY) is one of the loudest voices against this. He successfully pushed to defund this specific section of the infrastructure bill. He’s also sponsored legislation to completely overturn the rule. His argument isn’t about safety. It’s about civil liberties. He asks the hard question: What happens when the car decides you aren’t fit to drive?
Some opponents go further. They joke—or warn—that the next step is the car calling the police to pick you up. NHTSA hasn’t actually planned for that. Yet. The response could be a simple warning on the dash. It could be an intervention while the car is moving. We don’t know because NHTSA hasn’t settled on a plan.
How Passive Impairment Technology Actually Works (In Theory)
Current IIDs require you to blow. That’s it. The new technology needs to be invisible.
Possible approaches include:
– Measuring alcohol through the skin via touch points on the steering wheel.
– Taking readings from in-cabin exhalations using air quality sensors.
– Tracking eye motions and steering inputs to detect drowsiness or distraction.
The distinction matters. An active IID is a penalty. A passive system is a surveillance tool. It watches you. Constantly. That is where the privacy concerns come from. If the car can tell you are distracted, can it also tell you are speeding? Aggressive? The scope is unclear.
When Will Cars Have Built-In Sobriety Sensors?
The original timeline was ambitious. Automakers were supposed to have these systems in the 2028 model year.
That date is dead.
There is a near-zero chance any 2028 vehicle will come with a factory-installed passive IID. NHTSA has to report on this delay annually for the next decade. That’s ten years of excuses. At the current rate of progress, the odds of your next new car having a built-in breathalyzer are roughly equal to the alcohol content in a bottle of kombucha. Low. Tingly. But not enough to stop the car.
The law exists. The tech doesn’t. Meanwhile, drunk driving deaths continue. We are stuck waiting for a sensor that hasn’t been invented to save us from a problem we already have tools to address.
